TERMS AND CONDITIONS
PREAMBLE
1.º These general conditions of sale are agreed between the Florista Tulipa de Cristal of Marília de Jesus Malagueta Piçarra Pereira, with headquarters at Rua das Eiras 59 4ºA 2725-297 Mem Martins and establishment at Rua Nossa Senhora da Natividade 7 2725-403 Mem Martins with NIF: 182258580 and contact +351 219200833, hereinafter referred to as “COMPANY/MARCA/DOMINIO“ and people who wish to make purchases through the website www.tulipadecristal.pt hereinafter referred to as "User".
2. The parties agree that purchases made through the website www.tulipadecristal.pt will be governed exclusively by this contract, excluding any conditions previously available on the website.
ARTICLE 1 - PURPOSE
1. The purpose of these general conditions of sale is to provide and define all the information necessary for the User regarding the modalities of order, sale, payment and delivery of purchases made on the website www.tulipadecristal.pt
2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties.
ARTICLE 2 - ORDER
1. The User can easily place his order by completing the purchase process presented on the website www.tulipadecristal.pt , following the steps below.

2. The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale, as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.
3. The COMPANY will honor orders received online only up to the limit of available stocks. If the product is not available, the COMPANY undertakes to inform the User before the chosen delivery date. All floral works are handcrafted and made by various professionals as such are subject to some differences in relation to the photos presented, however, we guarantee that the flowers used are identical to those shown in the image unless stock breaks.
4. The data contained in the invoice are the User's responsibility. Once issued, the invoice cannot be reissued with changes.
5. Order requests must be made by the end of the day prior to the intended delivery date if delivery is intended in the morning or by 12 noon on the intended delivery day if delivery is intended in the afternoon and are valid until the date chosen for delivery of the same. If payment for the same is not received by our services by the intended delivery date, the order cannot be validated. Any value received after this date will be returned or used in a new order if this is the User's wish.
ARTICLE 3 - PAYMENT
1. On the website www.tulipadecristal.pt , the COMPANY offers the User the following payment methods via Easypay - Institution of Payment Lda.:

2. In the case of payment by credit card, the debit will be made to the User's card after confirming the order. If some ordered products are sold out, or for reasons attributed to the COMPANY they cannot be delivered on the desired date, their value will be credited to the User's card, after order cancellation.
ARTICLE 4 - DELIVERY
1. Due to the various time zones and opening hours, same-day delivery can only be guaranteed under the following condition:
These arrive by 12:00 (local time) at the destination. Preferably should arrive the day before.
2.We cannot guarantee deliveries on Saturday afternoons, Sundays (except Mother's Day) and Holidays, nor in camps, military bases, boats, ports and airports.

3. The delivery of orders will take place on the date and period of the day indicated in the order, except for orders intended to be delivered on special days (Valentine's Day; Women's Day and Mother's Day) due to the increase in number of them we cannot guarantee delivery at the times requested, however the delivery will be made on the desired day. Delivery is carried out by the COMPANY or by another suitably qualified florist if the delivery location is outside our own delivery zone.
4. Shipping costs are added to the order according to the delivery area indicated on the website www.tulipadecristal.pt and which you will have to select in advance. If the selected delivery area does not correspond to the recipient's address indicated by the User, the delivery will only be made after regularizing the difference in the shipping costs.
5. Deliveries at specific times will only be made after prior agreement. Delivery times are: Morning-9.30 am to 1 pm Afternoon 3 pm to 7 pm
6. If the recipient is not present, the delivery will be made to the person who receives us or we will make a second attempt, after telephone contact, in case no one answers us.
7. In case of refusal of receipt of the order by the recipient, it is considered made and there is no refund.
ARTICLE 5 - PRICES
1. Prices must be understood in Euros, with fees and taxes included, taking into account the VAT in force on the date of payment of the order.
2. If there is an increase in the price of any product, the User will be informed immediately and may choose to receive their order (paying the difference) or to cancel it.
ARTICLE 6 - CANCELLATION AND RETURN
1.The cancellation process is handled on a case-by-case basis by the Florista Tulipa de Cristal. The request must be sent in writing to the Tulipa de Cristal Florist's contact email
geral@tulipadecristal.pt until the day before the selected delivery date, with the order cancellation instructions being answered and defined by the COMPANY, by the same means of communication.
2. Whenever possible, the return must be made through the same payment method, but if this is not possible, the user must present proof of payment and ownership of the account or card, so that the return can be made by Bank Transfer.
3. The COMPANY undertakes to reimburse the User within a maximum period of 5 days.
4. Returns are not accepted unless:
1st The works delivered are not in accordance with the order placed and the User has not been informed of the change.
2º The state of conservation of the flowers, within 24 hours after delivery, is deficient due to their origin or transport.
In this case, the User can choose to receive another work in exchange or return the amount paid, after evaluating the state of the flowers by the Company.
5. If the value resulting from the exchange of products in an order is lower or higher than the initial value of the same, the conditions for adjustment will be indicated by the COMPANY.
ARTICLE 7 - PRIVACY POLICY
The processing of your data is carried out in compliance with the legislation on the protection of personal data. The same, subject to computer processing, will appear in the COMPANY's database(s) and are intended for the registration and presentation of other products and services, as well as institutional information, to be made available by them.
Its supply is optional and the right to access, rectify and cancel any data that concerns you directly, personally or in writing, is guaranteed, under the terms of the law, directly to the address on the homepage of this website.
ARTICLE 8 - CLAIMS AND CONFLICT RESOLUTION
The User can and should use our email address to make any complaint regarding their order. You can also do it directly at our establishment or through www.livroreclamacoes.pt
In case of consumer dispute, the User under article 18 of law 144/2015 may resort to the Consumer Conflict Arbitration Center of Lisbon.
